DRAFT — confirm the commercial terms below before publishing. The refund stance (for example, "no refunds" vs. "30-day money-back") is a business decision with real revenue and customer-trust consequences. The brackets mark choices only you can make. Note that some U.S. states and card-network rules can override a strict no-refund policy in specific situations.
1. Scope
This Policy explains billing, cancellation, and refunds for paid MyBizPoint subscriptions. It is part of our Terms of Service.
2. Free trial
If a free trial is offered, you will not be charged during the trial. To avoid being charged, cancel before the trial ends. If you do not subscribe, your access may be limited or your account marked as expired after the trial.
3. Billing cycle
Paid plans are billed in advance on a recurring basis — monthly or annually, depending on the plan you choose — through our payment processor, Stripe. Your subscription renews automatically at the end of each cycle until you cancel.
4. How to cancel
You may cancel at any time from your account settings or by emailing legal@makipoint.com. Cancellation stops future renewals. Your cancellation takes effect at the end of the current paid period, and you keep access until then. We do not automatically prorate or refund the remainder of the current period unless stated below or required by law.
5. Refunds
[CHOOSE ONE — this is the key decision.]
Option A — No refunds (default for SaaS). Payments are non-refundable, including for partial billing periods, unused time, or features you did not use. When you cancel, you keep access until the end of your current paid period, and you are not charged again.
Option B — Limited money-back guarantee. New customers may request a full refund of their first payment within [14/30] days of the initial charge by emailing legal@makipoint.com. After that window, payments are non-refundable. Refunds apply only to the first payment, not to renewals.
Annual plans. [State whether annual plans are refundable, partially refundable, or non-refundable after the guarantee window.]
6. Exceptions and required refunds
Regardless of the option above, we will honor refunds where required by applicable law or card-network rules, and we may, at our discretion, issue refunds or credits for:
- duplicate or clearly erroneous charges;
- extended Service outages materially affecting your use; or
- other situations we choose to resolve as a courtesy.
Discretionary refunds in one case do not obligate us to provide them in others.
7. Price changes
We may change subscription prices with at least 30 days' advance notice (or as required by law). If you do not agree to a new price, you may cancel before it takes effect.
8. Failed payments and downgrades
If a payment fails, we may retry the charge, suspend access, or downgrade your plan until payment succeeds. You remain responsible for amounts owed for periods you were subscribed.
9. Payouts and money you move through the Service
This Policy covers your subscription to MyBizPoint. It does not cover payments you make to contractors or collect from clients through integrations such as Stripe Connect — those are governed by Stripe's agreements and by your arrangements with those parties. Makipoint does not refund third-party payments you initiate.
10. Chargebacks
If you believe a charge is wrong, please contact us first at legal@makipoint.com so we can resolve it. Initiating a chargeback without contacting us may result in suspension of your account.
